1. Introduction
1.1 These Terms and Conditions (“Terms”) govern all driving tuition and associated services provided by One Time Pass Driving School Ltd, trading as One Time Pass Driving School (“the Company”, “we”, “us”, or “our”).
1.2 By booking or undertaking lessons, entering a franchise agreement, or otherwise engaging with our services, all learners and instructors (“you” or “your”) agree to be bound by these Terms.
1.3 These Terms form a legally binding agreement between One Time Pass Driving School Ltd and each learner or instructor and apply to all lessons, courses, and communications whether made in person, by telephone, or online.
2. Definitions
For the purposes of these Terms:
“Learner” means any person receiving driving tuition from the Company or its approved instructors.
“Instructor” means a driving instructor registered with the Driver and Vehicle Standards Agency (DVSA) and approved by the Company to deliver instruction under its brand.
“Lesson” means a period of driving tuition booked between a learner and an instructor.
“Course” includes any block of pre-paid lessons, theory sessions, or test packages.
“Franchise Agreement” refers to the contract between One Time Pass Driving School Ltd and self-employed instructors operating under the Company’s name.
3. General Provisions
3.1 The Company operates as a provider of driver training and road-safety education throughout the United Kingdom.
3.2 The Company may employ instructors directly or engage them on a self-employed franchise basis.
3.3 All instructors are required to hold a valid DVSA Approved Driving Instructor (ADI) or Potential Driving Instructor (PDI) licence, and to comply with the DVSA Code of Conduct.
3.4 The Company reserves the right to amend or update these Terms periodically. Any updates will be published on our official website.
4. Learner Responsibilities
4.1 Learners must hold a valid UK provisional driving licence and produce it at the first lesson.
4.2 Learners must be fit to drive, free from the influence of alcohol, drugs, or any condition that may impair safe driving.
4.3 Learners must ensure their eyesight meets the legal requirement to read a number plate from 20.5 metres.
4.4 Learners must give a minimum of 48 hours’ notice to cancel or reschedule a lesson.
4.5 Failure to provide 48 hours’ notice will result in the lesson being charged in full.
4.6 Learners are responsible for attending lessons punctually. Instructors are not obliged to extend lessons if the learner arrives late.
4.7 Learners must behave courteously towards instructors and comply with reasonable safety instructions at all times.
5. Instructor Responsibilities
5.1 All instructors engaged by One Time Pass Driving School Ltd must:
Hold a valid Approved Driving Instructor (ADI) or Potential Driving Instructor (PDI) registration issued by the DVSA.
Be insured for professional driving tuition purposes.
Use a vehicle that is roadworthy, taxed, MOT-certified (where applicable), and equipped with dual controls.
Display the correct DVSA identification badge (green for ADIs, pink for PDIs) during all lessons.
Conduct lessons in accordance with DVSA guidelines, the Highway Code, and the Company’s quality standards.
5.2 Potential Driving Instructors (PDIs)
PDIs are permitted to teach only while holding a valid DVSA Trainee Licence (pink badge).
PDIs must operate under the direct supervision of a fully qualified ADI or the Company’s appointed supervising instructor.
PDIs shall not advertise independently or take private bookings outside the One Time Pass Driving School system.
All tuition provided by PDIs shall be regularly monitored for quality and compliance.
The Company reserves the right to withdraw PDI teaching authorisation at any time if performance or conduct falls below expected standards.
PDIs must complete all required DVSA training and testing to achieve ADI status within the validity of their trainee licence period.
5.3 Instructors, whether ADI or PDI, must maintain professional standards at all times, including:
Courteous, non-discriminatory conduct towards learners and colleagues.
Clear communication and adherence to lesson schedules.
Prompt reporting of any accidents, incidents, or complaints to the Company.
5.4 Instructors must give a minimum of 48 hours’ notice to cancel or reschedule a lesson, except in genuine emergencies such as illness or vehicle failure.
5.5 All instructors are required to keep learner data secure and use it solely for instructional purposes in accordance with the Company’s Privacy Policy.
5.6 Instructors operating under a franchise agreement are self-employed and responsible for their own tax, insurance, and compliance with HMRC requirements. They must not represent themselves as employees unless specifically contracted as such.
5.7 The Company may audit instructor performance and conduct periodic reviews to ensure consistency with One Time Pass Driving School standards.
6. Lesson Bookings and Payments
6.1 Lessons may be booked individually or in advance as part of a course or block booking.
6.2 All lesson fees must be paid in full prior to or at the time of each lesson, unless otherwise agreed.
6.3 Payments are made directly through the Company’s online booking system.
6.4 Lesson fees are subject to change; however, any change will not affect confirmed and pre-paid bookings.
6.5 Block-booked lessons must be completed within six months of purchase unless otherwise agreed.
7. Cancellations and Refunds
7.1 Learners must give at least 48 hours’ notice to cancel or reschedule a lesson.
7.2 Cancellations made with less than 48 hours’ notice will incur the full lesson charge.
7.3 Refunds will only be considered where cancellation notice has been provided within the required period, or where the instructor cancels without reasonable cause.
7.4 In the event of instructor illness, vehicle breakdown, or other unforeseen circumstances, the Company will make every effort to reschedule lessons promptly.
7.5 Block booking refunds will be calculated based on lessons already taken, charged at the current standard rate.
8. Driving Tests
8.1 Instructors will advise learners when they are test-ready, but the decision to book a driving test remains with the learner.
8.2 The Company and its instructors will not be held liable for test cancellations or changes made by the DVSA.
8.3 The use of an instructor’s vehicle for a driving test is at the instructor’s discretion and contingent upon the learner demonstrating test-standard competency.
9. Liability and Insurance
9.1 The Company and its instructors accept no liability for any loss, damage, or injury arising during lessons or tests unless caused by proven negligence.
9.2 All instructors’ vehicles are covered by comprehensive motor insurance for tuition and test purposes.
9.3 Learners are advised that they are legally responsible for any driving offences committed during lessons or tests.
10. Instructor Franchise and Employment
10.1 Instructors may operate as self-employed franchisees or as employees of One Time Pass Driving School Ltd.
10.2 Self-employed instructors are responsible for their own tax, insurance, and compliance with UK employment law.
10.3 Franchise instructors must not use the One Time Pass Driving School name or branding outside their authorised area or after termination of their agreement.
10.4 The Company may terminate any franchise or employment agreement with immediate effect for serious misconduct, breach of policy, or failure to meet DVSA or Company standards.
11. Complaints Procedure
11.1 Any complaint regarding lessons, instructors, or the conduct of the Company must be made in writing through the official contact form on the website.
11.2 The Company aims to acknowledge all complaints within 7 working days and resolve them within 21 days.
11.3 If a complaint concerns an individual instructor, the matter will first be investigated internally before any external reporting to the DVSA (if necessary).
12. Data Protection and Privacy
12.1 All personal information is handled in accordance with the Company’s Privacy Policy, which complies with UK GDPR and the Data Protection Act 2018.
12.2 Instructors are prohibited from retaining or using learner data for any purpose outside their professional duties.
13. Termination
13.1 The Company reserves the right to terminate a learner’s tuition where:
Behaviour poses a safety risk.
Payment has not been made.
The learner repeatedly breaches these Terms.
13.2 The Company reserves the right to terminate any instructor relationship or franchise agreement for breach of professional standards or misuse of company property or reputation.
14. Governing Law
These Terms are governed by the laws of Scotland and the United Kingdom. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
15. Acknowledgement
By booking lessons or entering into any form of agreement with One Time Pass Driving School Ltd (Trading as One Time Pass Driving School), you confirm that you have read, understood, and agree to these Terms and Conditions.
